China Arnold, a mother convicted of microwaving her 28-month-old baby to death wants a new trial without the possibility of the death penalty.
She was convicted of microwaving her baby to death in 2005. According to pathological reports, baby was likely in microwave for at least 2 minutes.
Now, her attorney Christopher Thompson, is arguing that multiple errors were made in her previous trials and she should receive another one without the death penalty as an option. This would be the fourth trial in the case.

Arnold, 33, was already tried three times, with the death penalty a possibility each time, in the murder of her daughter, Paris Talley. Her first trial in February 2008 ended in a mistrial and her second trial ended in September 2008 when she was found guilty but the jury could not decide on the death penalty.
Montgomery County Common Pleas Judge Mary Wiseman imposed a sentence of life in prison, but that decision ultimately was overturned on appeal in November 2010.
Arnold’s third trial ended in May 2011 when she was sentenced to life in prison without the possibility of parole after a jury did not vote for the death penalty.-CBS
As previously reported by NewsOne, Arnold’s second conviction was overturned by the Second District Court of Appeals in Dayton after the prosecution’s star witness admitted she lied when she testified that Arnold had confessed to putting her baby in the microwave.
The witness claims the Montgomery County Prosecutor’s Office threatened her with jail time unless she gave that false testimony.
